§3. We point out that we collect, store, process and use the personal data received from our suppliers, customers, other business partners and interested parties such as names, addresses, telephone numbers, email addresses, details of contact persons, customer numbers, order numbers, and delivery data for the purpose of initiating, justifying and processing contractual and delivery relationships, including delivery, payment and any warranty or product liability.

The personal data collected from you are required for the conclusion and settlement of a contract. You are not required to provide this information. However, without this data we cannot conclude a contract with you.

The processing of your data takes place in this respect on the basis of Article 6 paragraph 1, b Basic Data Protection Regulations.

We also collect, store, process and use this information for the purpose of maintaining customer or business relationships, marketing and advertising our own products and services. The processing of your data is done on the basis of Article 6, paragraph 1, f General Data Protection Regulations. Our legitimate interest in the processing of your data results from our efforts to promote and sell our own products and services.

Furthermore, we process data that we receive under the legal requirements of credit reporting agencies (for example, the Schufa) for the purpose of credit checks concerning our suppliers, customers and other business partners. The processing of your data takes place in this respect on the basis of Article 6 paragraph 1, f General Data Protection Regulations. Our legitimate interest in the processing of this data arises from our interest in receiving the contractually due consideration (for example, compensation) for our services.

A transfer of personal data to third parties does not take place, with the exception of:

  • Transfers to third parties that we engage in to fulfill contractual and delivery relationships, such as banks / payment service providers that handle payments, forwarding agents and shipping companies handling deliveries;
  • Submissions to third parties that we engage in in marketing and advertising our own products and services, for example marketing service providers and printers;
  • Transfers to specialized service providers who provide services (contract data processors), such as IT service providers, at our instruction and under our responsibility for the purposes specified above;
  • Transfers to third parties to which we are legally obliged, for example to the tax office or other state authorities;
  • Transfers to third parties to fulfill our commercial and tax obligations, for example to our tax adviser.

A transfer of data to a third country outside the European Union, which is also not a party to the Agreement on the European Economic Area, will only take place if such transfer of data is necessary for the performance of a contract between you and us (for example, delivery to a third country).

The processing of your data takes place for the duration of the initiation and the settlement of a contract or delivery relationship and for the duration of the continuance of obligations from a contract or delivery relationship, for example, any warranty or product liability obligations, as well as for the duration of commercial or fiscal law retention periods.

With regard to the processing of your data for the duration of commercial or fiscal legal retention periods, the processing is carried out on the basis of Article 6 paragraph 1, c of the General Data Protection Regulations.

If we process personal data in order to advertise, you have the right to object at any time to the processing of your personal data for the purpose of advertising. If you object to the processing for purposes of advertising, your personal data will no longer be used for those purposes.

 

§4. According to Article 15 of the General Data Protection Regulations you have a right to know whether we are processing personal data concerning you and, if applicable, a right to access those personal data and, in particular, a right to the following information about such data:

4a) The processing purposes;
4b) The categories of these data;
4c) The recipients or categories of recipients to whom these data have been disclosed or are yet to be disclosed;
4d) The planned duration of the storage of these data or, if that is not possible, the criteria for determining that duration.

 

§5. You also have the right, under the conditions of Article 16 of the General Data Protection Regulations, to correct your incorrect or incomplete personal data and, under the conditions of Article 17 of the General Data Protection Regulations, a right to cancellation and, under the conditions of Article 18 of the General Data Protection Regulations, a right of limiting the processing of your personal data.

 

§6. According to. Article 21 para. 1 of the General Data Protection Regulations you also have the right, at any time, for reasons that arise from your particular situation, to make an objection to the processing of personal data related to you, which we based on Article 6 Paragraph 1, e or f Basic Data Protection Ordinance; this also applies to "profiling" based on these provisions.

You also have the right, according to Article 21 (2) of the General Data Protection Regulations to object, at any time, to the processing of personal data concerning you for the purposes of direct marketing; this also applies to profiling insofar as it is associated with such direct mail.

 

§7. You have a data transferability right under the conditions of Article 20 of the General Data Protection Regulation.

 

§8. If the processing of personal data concerning you is based on your consent, you have the right to revoke your consent at any time. The lawfulness of the processing on the basis of the consent is not affected until revocation.

 

§9. If you believe that the processing of your data violates data protection law or that your data protection rights are otherwise violated, you have a right of appeal to a supervisory authority, in particular to the supervisory authority responsible for us. The supervisory authority responsible for us is the country commissioner for data protection in Bavaria.
